Dr. Tessa Cole is a criminologist with expertise in advanced technology (including cybercrime). Dr. Cole is currently serving a temporary assignment with the Department of Homeland Security, Homeland Security Investigation where she is using her skills and knowledge to solve complex transnational organized crimes in the Counter-Proliferation Investigations and Global Trade Unit (CPI), and the Computer Forensics Unit. Prior to her appointment, Dr. Cole served as Director of Research for a 501(c)(3) Organization, Grace Street, that focused on the Commercial Sexual Exploitation of Children. She is a former corrections officer with the Department of Justice, Bureau of Prisons, and a higher education instructor.

  • Exploring the Effectiveness of Legislation Combating Digital Nonconsensual Sexually Explicit Image (DNSEI) Distribution

    Non-consensual porn distribution is the dissemination of sexually explicit images and/or photos without the consent of the individual featured in them. The literature suggests that non-consensual porn distribution is frequent with victims who experience similar negative effects to that of intimate partner violence (IPV) victims. It was estimated in 2014 that at least 3,000 pornographic websites contained a ‘revenge’ porn category of images. Victims who did not consent to the dissemination of…

    Non-consensual porn distribution is the dissemination of sexually explicit images and/or photos without the consent of the individual featured in them. The literature suggests that non-consensual porn distribution is frequent with victims who experience similar negative effects to that of intimate partner violence (IPV) victims. It was estimated in 2014 that at least 3,000 pornographic websites contained a ‘revenge’ porn category of images. Victims who did not consent to the dissemination of their digital sexually explicit images have reported similar experiences of those who have been victims of IPV. However the research suggests that the negative effects (e.g., emotional, psychological and physical experiences) on non-consensual porn distribution victims may be heightened because of the revictimization that occurs each time the victims’ images and/or information is repeatedly observed or shared online, which has been attributed to victims of child abuse who have maladaptive responses to their abuse. Research suggests current legislation has not assisted victims in combating and prosecuting the perpetrators who disseminate the victim’s digital porn without the victim’s consent. Additionally, US federal legislation, like Section 230 of the Communication Decency Act, arguably enables the digital distribution of victims’ non-consensual pornographic images and videos. Utilizing a content analysis, the current study analyses digital non-consensual porn distribution court cases in the USA, including Washington, DC, to assess the prevalence and effects of non-consensual porn distribution court cases. The review highlights the lack of diversity in the use of types of non-consensual porn distribution state statutes and the similarities between victims of IPV (e.g., rape) and non-consensual porn distribution prosecution that often leads to negative outcomes for victims.

    Sexting is a common behavior with studies reporting that 49% of adults
    have admitted to sending an intimate image and/or video of themselves
    to a romantic partner. The literature suggests that sexually explicit
    images are not safe with intimate partners and that sexts may be redistributed
    as nonconsensual pornography, often referred to as revenge
    porn. Revenge porn refers to situations where a sexually explicit image
    and/or video of a person is electronically distributed on a media platform
    without the depicted individual’s permission. Research indicates
    that 60% of individuals in a relationship have forwarded their partners’
    sexually explicit photograph(s). Employing a content analysis, the current
    study examined revenge porn statutes in the United States. The
    findings indicate that perpetrators are often protected through a lack of
    federal regulations. More specifically, the review highlights diversity in
    revenge pornography legislation, which may lead to issues in prosecution
    and remedies available to victims.

However, currently there are no federal provisions for victims of revenge porn. Currently, state statutes are the main method of legal action that victims may use to combat their perpetrators. 94% of Americans state that they believe their sexually charged photographs are safe with their significant other. However, 60% of partners admit to distributing the sexually exploitive photographs of their partner. The current study is a content analysis designed to explore current state legislation to depict how revenge porn is classified, consent is defined, and victims are protected via the various forms of penalties and sentences ascribed to the perpetrators.
