Position Information

Section Description:
The Health Care Section (HCS) works to ensure the right of Pennsylvanians to access needed health services and to protect citizens against misleading, deceptive, and unfair business practices in the provision of health services by mediating individual consumer complaints, investigating deceptive business practices, and bringing litigation, where necessary, to redress those practices. The section works to improve access and fairness in the health care industry by addressing wide-ranging public health concerns affecting the Commonwealth and the nation. The HCS is particularly concerned about practices in healthcare that have a disparate impact on racial and ethnic minorities and other vulnerable populations in the Commonwealth.

Position Type:
One-year Fellowship, Full-time, Non-civil service, Non-union.  This position is at-will with no guarantee of employment for any specific term.
 
Basic Function:
Deputy Attorneys General (DAGs) in the HCS provide varied legal services and advice on matters related to the enforcement of the Pennsylvania Unfair Trade Practices and Consumer Protection Law, other consumer protection laws, information privacy laws, and data security and breach notification laws, as they apply to the health care industry. Work involves the entire spectrum of the civil enforcement process including mediations, investigations, legal research and analysis, enforcement actions, settlements, and litigation and may include collaboration with other areas of the PA Office of Attorney General (OAG), including the Impact Section and Special Litigation Section.

Examples Of Duties

  • Performs enforcement activities including legal review and provides advice and recommendations with respect to the conduct of civil investigations and resulting legal actions;
  • Conducts legal research related to potential and pending investigations and litigation;
  • Assists senior attorneys in reviewing documents, interviewing witnesses, and trial preparation;
  • Works with agents and support staff to direct and develop mediations and investigations;
  • Analyzes evidence for possible healthcare legal violations;
  • Reviews amicus briefs, agency comments, and other materials;
  • Drafts pleadings and other documents related to litigation;
  • Participates in multistate working groups and multistate investigations and litigation with a  range of issues often with nationwide implications;
  • Prepares, presents, and argues cases before state and federal courts, as necessary;
  • Assists senior attorneys with planning, preparing, and presenting factual and expert witness testimony and exhibits, including summary and demonstrative exhibits;
  • Communicates with consumers and counsel regarding case-related activities;
  • Answers case-related correspondence;
  • Understands, participates in, and facilitates e-discovery efforts;
  • Performs additional and related work as required.
 

Minimum Experience and Training

Law students who are in their final year at an accredited law school and scheduled to graduate in the spring of 2024 are encouraged to apply. Those completing clerkships directly following graduation from law school are also encouraged to apply, as long as they have not held the title of “Attorney” in any capacity following graduation. The program begins in September 2024.

An in-person Fellowship at the above-listed location is preferred for the 2024 Honors Fellowship; however, we do offer telework options at the discretion of the Fellow’s supervisor and the needs of the office.
