Syracuse man avoids murder plea after torching SUV, killing drunk friend inside

Syracuse, NY -- A Syracuse man avoided a murder conviction Tuesday despite torching an SUV with his drunk and drugged friend inside because there wasn’t enough proof he meant to kill him, a defense lawyer said.

Timothy Benack, 51, had been facing trial on a murder charge in Justin Dougall’s death April 21, 2020 on the city’s North Side. Dougall was incapacitated in a Nissan Pathfinder when Benack set the vehicle on fire.
