Utica, N.Y. – A 38-year-old Utica man was indicted and accused of murder and attempted murder in the shooting of four people in September, police say.

Phillip Williams was charged with second-degree murder, three counts of second-degree attempted murder and second-degree criminal possession of a weapon, according to a news release from Utica police.

Williams is accused of fatally shooting Donte Harris, 23, in the head, police said. Three other men sustained gunshot wounds and survived.

The shooting occurred just before 8:20 p.m. on Sept. 11 on the 700 block of Noyes Street, said Sgt. Michael Curley of the Utica Police Department.

All four men were treated at St. Elizabeth’s Hospital. Harris was pronounced dead at 3 a.m. on Sept. 15, Curley said.

One man was shot in both legs, and another was hit in the abdomen, Curley said. None of their injuries were life threatening. One of the men was shot in the chest, he said. His injuries were considered life threatening but he was expected to survive, he said.

Williams was indicted by a grand jury on Wednesday. He is being held at the Oneida County Correctional Facility, according to Oneida County Sheriff’s Office records.
