The Federal Trade Commission (FTC) is an independent agency of the U.S. government that aims to protect consumers and ensure a strong competitive market by enforcing consumer protection and antitrust laws. Its principal purpose is to enforce non-criminal antitrust laws in the United States, by preventing and eliminating anticompetitive business practices, including coercive monopoly. President Biden announced on Monday that he intends to nominate Lina Khan, an associate professor of law at Colombia Law School, as the new Federal Trade Commission (FTC) chair. Khan specializes in antitrust and anti-monopoly tradition.
The current chair, Rebecca Slaughter, said in February that she had interests in “deterring problematic privacy and data security practices.” She also stated that “many of the largest players in digital markets are as powerful as they are because of the breadth of their access to and control over consumer data.”
Biden’s choice in Lina Khan represents a continuation of Slaughter’s tough stance on the tech industry, data collection, and privacy. Khan previously served on the House Judiciary Committee’s subcommittee on antitrust during an investigation into the monopolistic behavior of the tech industry. The subcommittee’s report explained that Amazon, Apple, Facebook, and Google "have captured control over key channels of distribution and have come to function as gatekeepers. Just a decade into the future, 30% of the world’s gross economic output may lie with these firms, and just a handful of others.”
Khan’s work outside the committee on the dominance of digital-era companies further points to a strong position on Big Tech, giving her nomination significant implications for those types of businesses.
