Participant (“Participant”), in consideration of being permitted to participate and play in the Club Sports Program at Nova Southeastern University Inc.’s (“NSU”) do hereby agree as follows:

1. As Participant of the Club Sports Program(s), I agree to comply with and abide by the rules and regulations stated in the Nova Southeastern University Club Sports Handbook and any Club Sports Program specific rule packets, both of which I have read in entirety, understand, and to which I agree. I understand that any faculty or staff member of Recreation and Wellness has the immediate right to revoke participation privileges in activities at any time, for any reason, upon verbal notification to any Participant.

2. I, the undersigned Participant, acknowledge that by signing this form I agree to be responsible for my conduct while participating in any Club Sports Program(s) and/or event(s), including all activities, and shall insure that I abide by the rules and regulations of Recreation and Wellness as stated in the Nova Southeastern University Club Sports Handbook and any Club Sports Program(s) specific rule packets.

3. I, the undersigned Participant, acknowledge that by signing this form, I represent that I am physically and mentally fit and otherwise able to undertake any and all physical sports activities in the Club Sports Program(s) and to use all NSU facilities, fields, sports areas, and any sports equipment of NSU related thereto.

4. The Participant hereby acknowledges that she/he has full and complete notice and understanding of all the risks inherent in NSU Club Sports activities which may cause, contribute to or result in the death or personal injury of the Participant or damage to the Participant's property (the "Risks"). These Risks include, but are not limited to: (I) injury, harm, or death from participating; (ii) injury, harm, or death of property of the participant.


SIGNATURE OF THE PARTY. An electronic signature of a party done pursuant to law, or a signature of a party transmitted by electronic means, shall be deemed an original signature for purposes of this Waiver.

Notice to Participant: please read the following language carefully before signing this Waiver.

Waiver and Release of Liability:

I, Participant, agree that Recreation and Wellness, Nova Southeastern University, Inc. its Board of Trustees, officers, agents and employees shall not be responsible or liable for injury, death or loss of property which may directly or indirectly result from my activities at, participation in Club Sports Program(s), and use of the Recreation and Wellness or Nova Southeastern University, Inc. facilities, courts, fields, pools, or sport area and any sport equipment for any reason whatsoever, including gross negligence or intentional misconduct on the part of Recreation and Wellness, Nova Southeastern University, Inc. its Board of Trustees, officers, agents and employees.

Furthermore, I, Participant, hereby release, waive and discharge Recreation and Wellness, Nova Southeastern University, Inc. its Board of Trustees, officers, agents and employees from and for any and all liability, present or future, however cause, to me, my personal representative, assigns, heirs and next of kin for any personal injury, including death, any loss or property damage which may result from my presence or participation in the aforementioned activities at the Recreation and Wellness facilities for any reason whatsoever, including the negligence of Recreation and Wellness, Nova Southeastern University, Inc. its Board of Trustees, officers, agents and employees.

I, Participant, hereby expressly agree that this Waiver and Release of Liability is intended to be as broad and inclusive as permitted by the laws of the state of Florida and that if any portion hereof is held invalid, the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceedings shall be Broward County, Florida.

I, Participant, confirm that I am of legal age and am freely signing this Waiver and Release of Liability. I, Participant, have read this Waiver and fully understand it. If I am not of legal age, my parent or legal guardian has signed this Waiver.
