Part Two of the 2023 ILTA Safety Survey and the Platinum Safety Award Applications are Due March 17th!
Part two of the 2023 ILTA Safety Survey is now out! This portion covers the yearly OSHA safety data and will be used to inform the annual ILTA safety report.
Once completed, please email the Excel spreadsheet to: safetysurvey@ilta.org by Friday, March 17.

ECHA Publishes Proposal Banning Use of PFAS Across EU
On February 7, the European Chemicals Agency (ECHA) published a proposal banning the use of PFAS across all European Union (EU) industry sectors within 18 months of enactment. A special phased-in restriction of up to 12 years was taken into consideration for uses that are difficult to replace including manufacturing, solvents, fire suppressants, military applications, and many others. ECHA seeks public comment on the published proposal for six months beginning March 22, 2023, and will host a virtual public hearing to discuss the details and impacts of the proposal on April 5, 2023.
Importantly, for firefighting foams containing PFAS, the document references a separate ECHA proposal released in March of 2022. This proposal outlines a transitional phase-out of the export, placing on the market, and use of PFAS-containing firefighting foams with different transitional periods per type of use. The ban on the export of PFAS-containing firefighting foams would apply at the end of the longest transitional period applicable, ten years after the restriction’s entry into force. During the transitional periods corresponding to each type of use, additional risk management measures apply to minimize the emissions of PFASs in the environment as long as technically and economically feasible.
New Water Coalition Urges Congress for PFAS CERCLA Liability Exemption
Water utility groups have formed the new Water Coalition Against PFAS (Coalition) to urge Congress to provide a statutory exemption from PFAS liability for drinking water and wastewater systems under CERCLA. The Coalition argues that EPA’s enforcement discretion policy will be insufficient to shield water utilities from liability, especially from being sued by third parties not covered by the discretion. Approval of any legislative waiver for water utilities or other sectors would likely diminish political opposition to EPA’s proposed designation of PFAS as hazardous substances under CERCLA, leaving mostly chemical manufacturers and downstream users liable.
EPA Hears from Communities on PFAS Roadmap
EPA is launching its series of regional community “listening sessions” to gather feedback on its PFAS Strategic Roadmap and gain insights into how PFAS impacts their livelihoods. With sessions held for EPA’s Midwest and Mid-Atlantic regions already, registration for future PFAS community engagement sessions, where the public can share feedback directly with EPA Regional and PFAS Council leaders, can be found here.
Senator Peters Reintroduces Push for Coordinated PFAS Research
On February 16, Senator Gary Peters (D-MI) reintroduced his bipartisan Federal Research Evaluation Act that aims to better address fragmented federal research efforts on PFAS. The legislation requires EPA, DOD, NSF, NIH, and other agencies to commission studies by the National Academy of Sciences (NAS) to produce four nonpartisan, consensus reports to advance research on PFAS toxicity and identify treatment options for contamination. Consequently, the bill could strengthen interagency collaboration and advanced scientific knowledge on PFAS.
Opportunities for Liquid Terminals in the Sustainable Aviation Fuel Boom
A global push for decarbonization of the aviation sector, which accounts for over 2% of global energy emissions, has led to a considerable increase in demand for sustainable aviation fuel (SAF). SAF is a “drop-in” liquid hydrocarbon fuel made from renewable or waste resources which has lower greenhouse gas emissions than petroleum-based jet fuels and can be used in existing airplanes and engines. Just last month Boeing announced that it will purchase 5.6 million gallons of SAF in 2023. To put this purchase in perspective, it is equivalent to 25% of all jet fuel used by Boeing in 2022. Similarly, United Airlines, along with 5 corporate partners, announced the creation of a venture capital fund focused on SAF production, accompanied by an initial $100 million investment. In response to the goal set by the Sustainable Aviation Fuel Grand Challenge (launched by the DOE, DOT, and USDA) of supplying enough SAF to meet 100% of aviation fuel demand by 2050, the Federal Government has also moved to increase SAF supply through several measures, including the creation of a SAF-specific tax credit in the Inflation Reduction Act of 2022. All of these efforts feed into a market trend that present an opportunity for liquid terminals.
