ILTA Holds Spring EHSS Meeting in Savannah, Georgia
ILTA’s annual spring Environment, Health, Safety & Security Committee meeting was held in Savannah, Georgia over March 13-15. The three-day event began with a tour of the local Colonial Terminals facility on Monday, hosted by ILTA Vice Chairman Pratt Summers of the same company.
On Tuesday, attendees convened for an opening discussion lead by Thomas Balazik with the United States Coast Guard (USCG) on its missions related to cybersecurity and what resources it provides for terminal owners and operators. Afterwards, the Security Subcommittee co-chairs Jerry Jerdine of Ergon, Inc. and Andrea Simonin of Vopak lead an interactive discussion on physical and cybersecurity best practices. The morning was capped with a presentation from Lieutenant Bill Gasperetti, USCG on the TWIC reader rule extension, next steps, and how ILTA members can look to partner with USCG on the rule’s implementation going forward.

The recent STOC Expo conference and trade show in Rotterdam, the Netherlands, brought together industry leaders, academics, and business professionals from around the world. The event was a great success, with attendees gaining insights into new technologies, trends, and innovations that are transforming supply chain management. Buckeye Partners Announces Launch of Energy Transition Development Company
Buckeye Partners, L.P. announced that it is launching BAES Infrastructure, a diversified energy company that will focus on the development, construction, and operation of energy transition projects. BAES Infrastructure will pursue new energy transition-related opportunities, with its seed assets being Swift Current Energy, OneH2, Bear Head Energy, a low carbon hydrogen and ammonia project under development in South Texas, and other advanced-stage solar development projects.

Hydrogen Storage at Liquid Terminals Provides Challenges, Opportunities for Industry
On March 24th, the U.N. Intergovernmental Panel on Climate Change released the final portion of their sixth assessment report which summarizes the impact, risk, and opportunities associated with addressing and mitigating climate change. Following recommendations laid out in previous reports, this version also stressed the need for major economic investments and the implementation of new technologies to mitigate the impacts of climate change. One of the specific recommendations has been the adoption of low-emission hydrogen, which has wide-reaching applications for abating carbon use in sectors where electrification is either difficult or impractical, like shipping, transport, and heavy industry. Accordingly, hydrogen demand is expected to grow as the energy transition continues. The International Energy Agency (IEA) projects that hydrogen demand will grow from 87 million metric tons (MT) in 2020 to 500-680 million MT in 2050, and the International Renewable Energy Agency (IRENA) projects that hydrogen will account for 12% of the global energy demand by 2050. Industry has taken note of these changes and has responded by increasing development of infrastructure projects to generate, store, and transport hydrogen.

EPA Proposes Drinking Water Rules to Regulate Six Types of PFAS
On March 14, EPA released its proposed national primary drinking water regulation (NPDWR) for six types of PFAS in drinking water. EPA’s proposed rule would require utilities to cleanse their drinking water supplies of any detectable levels of PFOS and PFOA, as well as monitoring for and in certain instances cleansing drinking water for GenX, PFBS, PFHxS and PFNA. The addition of these four types of PFAS was done following a “hazard index” approach and is a departure from the originally anticipated proposal, in which just PFOS and PFOA were expected to be regulated. By specifying the types of PFAS that will be included in the rule, EPA has set an important precedent whereby regulation and clean-up efforts may be restricted to certain chemical compounds. As conversations continue around CERCLA designations, this information will be particularly relevant. Under SDWA, EPA is required to finalize an NPDWR within 18 months of proposing the rule.
EPA Holds Public Listening Sessions Regarding CERCLA PFAS Enforcement
EPA has held two public listening sessions to collect stakeholder feedback regarding its enforcement discretion and settlement policy under CERCLA for PFAS contamination. Through CERCLA, EPA intends to focus on manufacturers, federal facilities, and other industrial parties whose actions result in the release of significant amounts of PFAS. EPA does not intend to pursue CERCLA enforcement for PFAS contamination against community water utilities and publicly owned treatment works, publicly owned or operated municipal solid waste landfills, municipal airports and fire departments, and entities that utilize biosolids. ILTA participated with verbal comments in the March 23 listening session, stating that enforcement discretion is an important first step for liquid terminals, as it brings certainty to the industry and reinstates ensured safety for terminal workers and communities. ILTA will continue to urge EPA to include liquid terminals in its list of entities it does not intend to pursue under CERCLA.
State Drinking Water Regulators Advise Against a PFAS NECI
State drinking water program officials are advising EPA to forgo, for now, adding PFAS contamination to its National Enforcement and Compliance Initiatives (NECI) for fiscal years 2024-2027. In its March 3 comments, the Association of State Drinking Water Administrators (ASDWA) stated that the proposed NECI for PFAS would be highly inefficient and an ineffective use of federal or state resources. ASDWA considers itself “neutral” on the proposed PFAS NECI, suggesting that EPA should focus on developing and finalizing current regulatory initiatives targeted at PFAS contamination, while helping ensure states are ready to implement these new rules. ASDWA urges EPA to reconsider NECIs for PFAS after the new or updated regulations are finalized and compliance can be verified and measured.
ILTA submitted comments in response to EPA’s NECI proposal, focused on the need for EPA to use enforcement discretion for the liquid terminal industry to provide legal and financial certainty for the industry and to safeguard health and safety in and around terminal facilities.
