ILTA 2023 Operating Conference and Trade Show A Smashing Success!
The International Liquid Terminals Association held its annual Operating Conference and Trade Show over May 22-24 at the Marriott Marquis in Houston, Texas. This year’s event featured keynote presentations and conference sessions from industry experts, scholars, and public leaders such as NASA astronaut Capt. Scott Kelly and Executive Assistant Director for Infrastructure Security at the Cybersecurity and Infrastructure Security Agency Dr. David Mussington.
In all, over 500 people attended the conference, over 300 companies exhibited at the trade show, and 4000 individuals across the industry walked the trade show floor, returning the show to pre-COVID-19 levels! ILTA cannot thank our Platinum, Gold, Silver, Champion, Ally, and the rest of our sponsors enough for helping to make this event possible.

Congratulations to all the 2023 ILTA Safety Award Winners!
The Safety Awards presentation was held after lunch on the first day of ILTA 2023. Dr. Kathryn Clay spoke about the importance of safety culture in the liquid terminal industry as well as the updated safety awards program.
For the 2023 Safety Awards program, the ILTA Health and Safety Committee updated the selection process to include a focus on leading safety indicators and to complement a company’s total recordable incident rate (TRIR) for the previous year. To receive the 2023 ILTA Safety Excellence Award, companies were required to score in the top two quartiles for both the leading indicator survey and the lagging indicator survey (OSHA TRIR data).
Dr. Clay announced the 26 winners of the Safety Excellence Award and the two Platinum Award winners.

Congratulations to the Winners of the ILTA 2023 Leadership Awards!
During the ILTA conference, ILTA recognized three individuals nominated by their peers who are making significant contributions to the industry. Chris Stine of Norwest Engineering received the inaugural ILTA Outstanding Young Professional Award for his leadership and growth early into his career. This award is an opportunity to acknowledge the achievements and potential of young professionals who are shaping the future of our industry.
Likewise, Rob Ferry of Trinity Consultants and Jack McCrossin of CITGO received the inaugural ILTA Distinguished Service Award recipients. Both have made significant contributions to the association, demonstrated through their continued leadership and innovation across ILTA’s working groups and committees, and have a long-standing reputation for integrity and professionalism across the industry.

Legislative Developments on PFAS Liability Release
On May 3, Senator Cynthia Lummis (R-WY), along with Senators John Boozman (R-AR), Kevin Cramer (R-ND), Lindsey Graham (R-SC), Markwayne Mullin (R-OK), Peter Ricketts (R-NE), Dan Sullivan (R-AK), and Roger Wicker (R-MS) sponsored a package of five bills regarding PFAS release liability which were referred to the Committee on Environment and Public Works. Each of these bills exempted a specific type of organization from CERCLA obligations regarding the release of per and polyfluoroalkyl substances. This includes agricultural operators, solid waste/compost operators, water/wastewater treatment facilities, AFFF users and airports. The bills prevent any third party, including federal and state governments or Indian Tribes, from recovering costs or damages from these groups.

ILTA Conference 2023 – A Look Into the Evolving PFAS Landscape
Over the course of two days and three panels, ILTA’s annual conference featured renown experts who delved into the challenges, advances, and updates regarding PFAS chemicals and their presence in the firefighting foams commonly used by ILTA members. Importantly, the experts provided information on remediation techniques where contamination has occurred and on the development of PFAS-free foams for use at terminal facilities. Each of these panels provided both practical and strategic information aimed at ensuring participants have the tools needed to navigate this changing and complex issue.

Opportunities for Liquid Terminals in EPA’s Proposed Power Plant Emissions Standards
On May 23, EPA released its proposed greenhouse gas (GHG) standards for fossil fuel-fired power plants, a suite of guidelines to improve the emissions performance of applicable electric generating units. While the proposal would set new limits for certain gas, coal, and other types of power plants, the proposal also sets a pathway for the co-firing of low-GHG hydrogen. EPA’s proposal reflects the growing demand for more sustainable fuels, justifies a growing network of hydrogen infrastructure, and offers a key role for liquid terminals to play in the energy transition.

ILTA Launches Air Permitting Working Group
In a May 9, 2023, meeting with industry representatives, including ILTA members, the Environmental Protection Agency (EPA) discussed an upcoming Technology Review of the New Source Performance Standards (NSPS) for storage tanks, 40 CFR Part 60 Subpart Kb, which applies to the construction, reconstruction, or modification of tanks storing volatile organic liquids. Pursuant to a consent decree in Environmental Integrity Project, et al. and Concerned Citizens of St. John et al. v. Michael Regan, the EPA is expected to release a proposed new NSPS, 40 CFR Part 60 Subpart Kc, by September 29, 2023.
In that NSPS standards are effective as of their proposal date, the pending NSPS Subpart Kc is expected to apply to storage tank projects that commence after September 29, 2023. The EPA is presently reviewing control technologies and industry practices to propose a best system of emissions reduction for storage tanks. As a part of the consent decree, the agency is expected to finalize the rulemaking by September 30, 2024. Again, however, once finalized the new standard will apply retroactively to the proposal date.
